The following instructions will guide you through the process of e-filing a Motion for Relief from Stay in CM/ECF. These instructions assume you have already accessed and logged into CM/ECF (see How to Access CM/ECF).
E-Filing Instructions:
Select [Bankruptcy]
Click [Motions/Applications]
Enter Case # and click [Next]
Select [Relief from Stay - Motion] and click [Next]
The Select the Party screen displays
First, verify the case name & number is correct
If the name of the party you are searching for is listed, click on the name, then click [Next] to continue
If the name of the party you are searching for is not listed, click Add/Create New Party
Enter a Last or Business name and click [Search]
If the party is found, select the party and click [Select name from list]. If "No person found", click [Create new party]
Enter/review the party information, making sure to select a Role and click [Submit]
Ensure the correct party is selected, and click [Next]
Note: if this is the first time you have filed on behalf of this party in this case, you will be asked if you want to create an association between you as the attorney and the party. Check the box to make the association.
Click [Browse] to Select a PDF document (the motion), then click the "Yes" button
Add the attachment(s), including the Notice, Proposed Order, and Certificate of Service. For example, click [Browse] and select the Notice of Hearing. In the Description field type "Notice of Hearing". Click [Add to List]. Continue until all attachments have been added.
Enter hearing information
The next screen will display the amount of the filing fee. Upon completion of filing, you will be prompted to enter your credit card information for payment of this filing fee. See procedures at the end of this page for notifying the court if you are exempt from paying the filing fee. Click [Next] to continue.
The docket text appears
Only if needed, click inside the Free Text box and enter additional descriptive information (most times no additional text is needed).
If this is a Motion for Relief from Co-Debtor Stay, add "for Co-Debtor" in the free text box
Click [Next]
The Final Docket Text screen displays.
Proof this screen carefully! No further editing is allowed after this screen. If the docket text is correct, click [Next] to submit.
If any part of the docket text is incorrect, click the browser [Back] button to return to the screen you need to correct. Then process the screens again with the respective [Next] or [Submit] buttons.
NOTE: To abort or restart the transaction at any time up until the final docket text screen, click the Bankruptcy or Adversary hyperlink on the Menu Bar.
The Notice of Electronic Filing screen displays.
Print a copy of this notice by clicking the browser [Print] button.
NOTE: You must enter your PACER login and password to view any documents or reports or perform any queries.
A pop-up credit card payment window will appear on the screen overlaying the Notice of Electronic Filing. This screen will contain the new filing fee charge and any other outstanding CM/ECF filing fees. You must pay all filing fees incurred with a credit card.
IMPORTANT NOTE: If you are exempt from paying this filing fee for any reason (i.e. this is a motion for relief from co-debtor stay), click continue filing when presented with the pop-up credit card payment window. Immediately upon completion of filing, send an e-mail to the Court’s help desk - helpdeskde@deb.uscourts.gov. The subject line of the e-mail should be the case number only. The e-mail should state the docket number and whether the filing fee is exempt, deferred, or waived. Also include an explanation as to why the filing fee is exempt, deferred, or waived. Please note that if you do not comply by e-mailing the Court, your fee will remain as outstanding, and at the appropriate time you will be prevented from further e-filing until the fee is resolved.
