DELAWARE CHAPTER 13 PROCEDURES: 

Filing procedure and service for Chapter 13 Amended Plans. Modified Plans and Docket withdrawals: 

a.  Amended plans must be served on all creditors.  See local rule: 3023-1( c )(i) 

b.  Amended plans should be numbered sequentially 

c.  Amended plans incorrectly filed or served may be subject to a deficiency notice issued and docketed by the Court. 

d.  Modified Plans should be numbered sequentially and filed with a brief Motion  requesting approval of the proposed modified plan.  The Court will notice modified plans.  No hearing is required, so no hearing information should be docketed or noticed. 

e. If another modified plan is filed before a previous modified plan is approved, the previous modified plan should be withdrawn and identified on the docket as withdrawn and served on all creditors.   

f. The foregoing does not apply to modified plans that the Court has approved. A Motion that vacates the order approving the modified plan is required and if appropriate requesting approval of a subsequent modified plan. 

g.  Interim Confirmation:  Any changes to the Plan prior to Final confirmation would be identified as an Amended Plan.
