Noticing of 341 Meeting in a
Chapter 11 Case
In all Chapter 11 cases, counsel for the debtor is responsible for noticing the
341 Meeting. Upon the U.S. Trustee's filing of a Request to Schedule Section 341
Meeting, the Court will mail written notification of this filing to debtor's
counsel. This notification will instruct counsel to prepare the Notice
of Commencement of Chapter 11 Bankruptcy Cases, Meeting of Creditors and Fixing
of Certain Dates (341 Meeting Notice). Deadlines for mailing this
notice and for
e-filing the Notice and Certificate of Service will also be included in the
notification you receive from the Court. To facilitate this process, a form for
the Notice has been posted on the Court's website (download this form in:
Microsoft Word or
WordPerfect format.)
It is the responsibility of debtor's counsel to modify the form as needed for
the Chapter 11 case. The notice may be distributed in the format provided.
Please enter information as appropriate. The date, time, and location of the 341
Meeting can be found in the U.S. Trustee's Request to Schedule Section 341
Meeting. Be sure to include a contact telephone number for informational
purposes. Do not include the address and phone number of the Court. Only include
claims agent information if the claims agent has been approved through Court
Order. If a claims agent has been approved by Court Order, include a toll-free
contact telephone number and specify the claims agent information. If you
substantively modify the 341 Notice, you must contact David D. Bird, Clerk of
Court, for approval prior to mailing. If you do not substantively deviate from
the form, there is no need to forward the notice to the Clerk for approval.
The five (5) agencies below have requested notification in all Chapter 11 cases
filed in this Court. Debtor's counsel is required to add these agencies
to the Notice List in all Chapter 11 cases:
